
With its experienced staff of attorneys and other litigation personnel, the Firm is well equipped to handle
the vigorous prosecution and defense of lawsuits involving virtually all types and sizes of legal disputes
in state and federal courts in Iowa and around the country.
The Firm's attorneys have successfully represented clients at every level of the state and federal court
systems, in jury trials and bench trials, as well as before regulatory and administrative agencies in arbitration,
mediation, and through other means of Alternative Dispute Resolution (ADR). The Firm's litigation attorneys have
had cases concerning all types of business, commercial, and contract disputes, including shareholder and
partnership litigation and complex and class action litigation in courts throughout the United States. Due to
the Firm's familiarity with local courts, it often serves as local counsel for out-of-state parties or their
counsel with litigation needs in Iowa. The Firm's attorneys also have an extensive appellate court track record
in both federal and state court systems. The litigation department includes two members of the American College
of Trial Lawyers. One member of the firm is the co-author of a casebook on the Rules of Evidence that has been
adopted in numerous law schools across the country. Duncan, Green, Brown & Langeness attorneys are admitted to
practice in Iowa, Arizona, Florida, Illinois, New York, Ohio, and South Dakota, as well as many federal district
courts and circuit courts of appeal and the U.S. Supreme Court.
The firm has in-depth experience in representing plaintiffs and defending all types of personal injury litigation.
Several attorneys in the firm have particular experience in handling commercial or business liigation including
contract, intellectual property, and corporate governance disputes. The firm has a long history of involvement
in professional liability litigation including medical, legal, engineering, architectural, and accounting
malpractice claims.
The Firm has extensive experience in the area of class actions and other complex litigation. Class actions are
lawsuits brought on behalf of a group of similarly situated persons who have been harmed in a similar manner.
Since the Firm's inception, its attorneys have litigated class actions and other large commercial cases in federal
and state courts in Iowa and throughout the United States for both plaintiffs and defendants.
The firm's lawyers represent corporations, individuals and associations in private antitrust litigation involving
claims or price fixing, concerted refusal to deal, actual or attempted monopolization, price discrimination, or other
alleged violations of federal and state antitrust laws.
Creditor Bankruptcy representation is one of our particular areas of skill. The Firm will vigorously protect the interests
of secured or unsecured creditors in bankruptcy matters. We have extensive experience in both contested matters and adversary
proceedings including: motions for relief from stay or for adequate protection payments; cash collateral protection; defending
the nondischargeability of a claim or prosecuting an action for denial of general discharge; defending preference avoidance
actions; protecting interests relating to executory contracts or leases; reaffirmation agreements; and negotiating fair and
equitable treatment for the creditor or objecting to the proposed treatment of the creditor in a Chapter 11, 12 or 13 plan
of reorganization.
The Firm has lawyers who practice concentrating in the areas of toxic tort litigation; environmental insurance litigation;
water and transactions involving environmental issues. Our practice covers all major environmental statutes and programs and
the Firm's work includes compliance counseling; obtaining and negotiating permits and appealing unfavorable permit terms and
conditions; facility cleanups, including risk-based experience; working closely with environmental consultants; administrative
adjudication before federal and state agencies; and federal and state court litigation, both at the trial and appellate levels.
Our attorneys have significant experience in the representation of public officials and entities, as well as municipalities
such as the City of Des Moines. Litigation of this nature has involved the defense of claims alleging Constitutional
violations pursuant to 42 U.S.C. ¤ 1983, and personnel and employment related claims involving allegations of discrimination,
sexual harassment and general tort litigation. Our attorneys have been frequently invited to lecture on risk management
and litigation issues unique to government officials, employees and agencies, and actively assist our clients in the prevention
of claims in order to avoid the necessity for litigation. As trial and appellate counsel, our attorneys have been successful
in working closely with our clients to develop and execute vigorous defense strategies.
